4. Client Responsibility & Implementation

You acknowledge and agree that:

  • Compliance outcomes depend on how materials are implemented within your business
  • You are solely responsible for implementing, adapting, and enforcing all policies and procedures
  • You are responsible for staff communication, training participation, and workplace culture
  • You must ensure all materials are suitable for your specific business operations

Sentrawell provides the framework. Implementation is the responsibility of the client.

Sentrawell is not responsible for:

  • Workplace behaviour or staff conduct
  • Failure to implement systems correctly
  • Failure to act on identified risks or issues

5. WorkSafe & Regulatory Disclaimer

Sentrawell:

  • Is not affiliated with WorkSafe or any government or regulatory body
  • Does not act on behalf of any regulator
  • Does not guarantee compliance approval or certification

Use of Sentrawell services does not imply endorsement by any authority.

6. Training & Behaviour Disclaimer

Completion of training modules or use of Sentrawell materials:

  • Does not guarantee behavioural change
  • Does not eliminate workplace risk
  • Does not prevent incidents, complaints, or claims

Ongoing management, supervision, and enforcement remain the responsibility of the client.

7. Limitation of Liability

To the maximum extent permitted by law:

Sentrawell will not be liable for:

  • Any direct, indirect, incidental, or consequential loss
  • Workplace claims, disputes, investigations, or legal action
  • Regulatory penalties or enforcement action
  • Loss of revenue, business interruption, or reputational damage

Any liability (if applicable) is strictly limited to:

8. Indemnity

You agree to indemnify, defend, and hold harmless Sentrawell, its directors, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, or expenses arising from:

  • Your use or misuse of Sentrawell materials
  • Failure to properly implement policies or systems
  • Workplace incidents, disputes, or legal actions
  • Breach of these Terms & Conditions

9. No Guarantee of Compliance Outcome

While Sentrawell is designed to support psychosocial compliance:

We do NOT guarantee:

  • Passing a WorkSafe or regulatory inspection
  • Immunity from complaints, claims, or penalties
  • That all risks will be identified or eliminated

Compliance outcomes depend on:

  • Implementation
  • Workplace practices
  • Ongoing management and review

10. Subscription Terms

For subscription-based services:

  • Fees are billed annually (or as specified)
  • Access is granted for the subscription period only
  • Subscriptions automatically renew unless cancelled prior to the renewal date

Failure to pay may result in:

  • Suspension or termination of access

11. Intellectual Property

All Sentrawell materials are:

  • Owned exclusively by Sentrawell
  • Licensed (not sold) to the client

You may:

  • Use materials internally within your business

You may NOT:

  • Copy, reproduce, or modify for resale
  • Share with external parties
  • Distribute, sublicense, or commercialise materials

12. Digital Platform & Third-Party Services

Sentrawell may use third-party platforms (including learning management systems and payment providers).

Sentrawell is not responsible for:

  • Platform outages or downtime
  • Data loss or technical issues
  • Interruptions beyond our control

13. Confidentiality & Account Security

You agree to:

  • Keep login details secure
  • Not share access with unauthorised users

You are responsible for all activity under your account.

14. Termination

Sentrawell reserves the right to:

  • Suspend or terminate access where these Terms are breached
  • Refuse service where misuse or unauthorised use occurs

No refunds will apply in the event of breach.

15. Refund Policy

Due to the nature of digital services and immediate access to materials:

  • All payments are non-refundable
  • Once access is granted, services are deemed delivered
